    These Terms of Service ("Terms") govern your access to and use of the products and services provided by HAIDAMOUS ADMINISTRACAO E TECNOLOGIA LTDA ("Automads," "we," "us," or "our"), including the Automads web application, APIs, integrations, and any related features or tools (collectively, the "Services").

    By creating an account or using our Services, you agree to be bound by these Terms. If you disagree with any part of these Terms, you may not access our Services.

    1. Definitions

    • "Account" means the user account you create to access the Services.
    • "Company Workspace" means the organizational tenant within Automads to which your Account belongs.
    • "Connected Platforms" means advertising platforms, data sources, and other third-party services you connect to Automads (including, without limitation, Meta Ads).
    • "Advertising Data" means account information, campaign structures, performance metrics, creative assets, and any other data retrieved from Connected Platforms on your behalf.
    • "AI Features" means any automated analysis, tagging, transcription, reporting, or enrichment capabilities provided by Automads.
    • "Third-Party Integrations" means external applications, AI assistants, and developer tools that access Automads functionality through our APIs or protocols, including but not limited to ChatGPT, Claude, and Cursor.

    2. Account Registration and Security

    2.1. You must provide accurate and complete information when creating an Account. You represent that you have the authority to bind the organization associated with your Company Workspace.

    2.2. You are responsible for maintaining the confidentiality of your Account credentials and for all activities that occur under your Account, including activity through authorized integrations and connected services.

    2.3. You must notify us immediately at support@automads.ai if you become aware of any unauthorized use of your Account or any security breach.

    2.4. We reserve the right to suspend or terminate Accounts that violate these Terms, show signs of unauthorized access, or remain inactive for an extended period.

    3. Use License and Restrictions

    3.1. We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Services for your personal or internal business purposes, subject to these Terms and any applicable subscription plan.

    3.2. You must not:

    • Use the Services for any illegal or unauthorized purpose.
    • Attempt to reverse-engineer, decompile, or extract source code from the Services.
    • Resell, redistribute, or sublicense access to the Services or data retrieved through them without our prior written consent.
    • Use automated systems (other than authorized integrations) to scrape, extract, or harvest data from the Services.
    • Circumvent rate limits, authentication mechanisms, or access controls.
    • Share Account credentials or access tokens with unauthorized third parties.
    • Interfere with or disrupt the integrity or performance of the Services.
    • Use the Services to store or transmit malicious code or material that violates any applicable law.

    4. Connected Platforms and Advertising Data

    4.1. Your connections. The Services allow you to connect advertising platforms (such as Meta Ads) to import and analyze your Advertising Data. By connecting a platform, you represent that you have the necessary rights and permissions to access that platform's data and to authorize Automads to retrieve it on your behalf.

    4.2. How we access your data. Automads retrieves Advertising Data using the access tokens and credentials you provide when connecting a platform. We access only the data required to deliver the features you use. We do not modify, create, or delete campaigns, ads, or other resources in your Connected Platforms unless a feature explicitly states otherwise and you authorize the action.

    4.3. Token management. You are responsible for ensuring that your Connected Platform credentials remain valid. If an access token expires or is revoked, Automads will be unable to retrieve data until you reconnect the platform.

    4.4. Connected Platform terms. Your use of Connected Platforms remains subject to those platforms' own terms of service, advertising policies, and API terms. Automads is not responsible for changes to Connected Platform APIs, rate limits, or data availability.

    4.5. Data accuracy. Advertising Data is retrieved from Connected Platform APIs and presented as-is. We do not independently verify its accuracy, completeness, or timeliness. Discrepancies between data shown in Automads and data in the Connected Platform's native dashboard may occur due to reporting delays, attribution model differences, or API limitations.

    5. AI Features and Automated Analysis

    5.1. Automads uses artificial intelligence and machine learning to provide features such as creative tagging, transcription, performance analysis, and reporting.

    5.2. AI-generated outputs including tags, transcriptions, insights, and recommendations are automated and may contain errors. They are intended as supplementary information and should not be relied upon as the sole basis for business decisions.

    5.3. We continuously improve our AI Features, which means outputs may change over time as our models and algorithms are updated.

    6. Third-Party Integrations

    6.1. How integrations work. Automads provides APIs and protocols that allow Third-Party Integrations to access your Advertising Data and AI Features on your behalf. When you authorize a Third-Party Integration, you grant it permission to make requests to Automads using your credentials.

    6.2. Data shared with integrations. When you use the Services through a Third-Party Integration, data which may include account names, campaign names, performance metrics, creative asset URLs, AI-generated tags, and transcriptions is transmitted to that integration and processed according to its own terms and privacy practices. You acknowledge that once data leaves Automads' servers, it is subject to the receiving platform's data handling practices.

    6.3. Rate limits. API and integration requests are subject to rate limits per Company Workspace. Exceeding these limits will result in temporary throttling. We reserve the right to adjust rate limits at any time.

    6.4. Third-Party Integration terms. When you use Automads through a Third-Party Integration, you are also bound by that integration's terms of service and privacy policy. Automads is not responsible for how Third-Party Integrations process, store, display, or use data obtained from our Services.

    6.5. Availability. Integrations depend on the availability of our servers, Connected Platform APIs, and the Third-Party Integration itself. We do not guarantee uninterrupted access and are not liable for outages, errors, or delays caused by any of these systems.

    7. Subscription and Billing

    7.1. Certain features of the Services require a paid subscription. Pricing, plan features, billing cycles, and payment terms are presented at the time of purchase and may be updated with reasonable notice.

    7.2. Some features (including API access and certain integrations) may require an active subscription and at least one active Connected Platform within your Company Workspace.

    7.3. Payment processing is handled by third-party payment providers. We retain subscription and billing metadata but do not store full payment card numbers.

    7.4. Unless otherwise stated, subscriptions renew automatically at the end of each billing period. You may cancel at any time; cancellation takes effect at the end of the current billing period.

    8. Intellectual Property

    8.1. The Services and their original content, features, functionality, design, and underlying technology are owned by Automads and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

    8.2. Your Advertising Data and content remain your property. By using the Services, you grant Automads a limited, non-exclusive license to process, store, analyze, and display your data solely for the purpose of providing and improving the Services.

    8.3. Feedback, suggestions, or ideas you provide about the Services may be used by Automads without obligation or compensation to you.

    9. Limitation of Liability

    9.1. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, AUTOMADS AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, REVENUE, DATA, ADVERTISING SPEND, OR BUSINESS OPPORTUNITIES, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES.

    9.2. IN NO EVENT SHALL AUTOMADS' TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICES EXCEED THE AMOUNTS YOU HAVE PAID TO AUTOMADS IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

    9.3. AUTOMADS IS NOT LIABLE FOR DECISIONS YOU MAKE BASED ON DATA, INSIGHTS, OR AI-GENERATED OUTPUTS PROVIDED THROUGH THE SERVICES, INCLUDING ADVERTISING BUDGET ALLOCATION, CAMPAIGN OPTIMIZATION, OR CREATIVE STRATEGY.

    9.4. These limitations apply regardless of the theory of liability (contract, tort, strict liability, or otherwise) and even if Automads has been advised of the possibility of such damages.

    10. Disclaimer of Warranties

    10.1. THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

    10.2. Automads does not warrant that the Services will be uninterrupted, error-free, secure, or free of viruses or other harmful components, or that defects will be corrected.

    10.3. We do not warrant the accuracy or reliability of any Advertising Data retrieved from Connected Platforms, or any output generated by AI Features.

    11. Indemnification

    You agree to indemnify and hold harmless Automads, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to: (a) your use of the Services; (b) your violation of these Terms; (c) your violation of any rights of a third party, including Connected Platform terms; (d) your misuse of data obtained through the Services; or (e) any claim that your advertising content or data infringes the rights of a third party.

    12. Termination

    12.1. We may terminate or suspend your Account and access to the Services immediately, without prior notice, for conduct that we determine, in our sole discretion, violates these Terms, is harmful to other users or third parties, or is otherwise objectionable.

    12.2. You may terminate your Account at any time by contacting us at support@automads.ai or through the account settings in the application.

    12.3. Upon termination, your right to use the Services ceases immediately. Any active integrations and access tokens associated with your Account will be revoked. We may retain certain data as required by law or for legitimate business purposes, as described in our Privacy Policy.

    13. Modifications to Terms

    13.1. We reserve the right to modify these Terms at any time. Updated Terms will be posted on this page with the "Last Updated" date revised accordingly.

    13.2. For material changes, we will provide notice through the Services or by email. Your continued use of the Services after the effective date of revised Terms constitutes acceptance of the changes.

    14. Governing Law and Jurisdiction

    These Terms shall be governed by and construed in accordance with the laws of the Federative Republic of Brazil. Any disputes arising out of or related to these Terms or the Services shall be submitted to the courts of the city of Sao Paulo, State of Sao Paulo, Brazil, which shall have exclusive jurisdiction.

    15. Severability

    If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that the remaining provisions remain in full force and effect.

    16. Entire Agreement

    These Terms, together with the Privacy Policy and any other agreements expressly referenced herein, constitute the entire agreement between you and Automads regarding the Services.
